Planning for the Lifetime Care of Your Children

Having a Will does not ensure the care of your kids if the unthinkable happens!

As a parent, do you have peace of mind knowing your children are protected if the unthinkable were to happen? If you are the parent of young children, your estate plan should begin with ensuring your children will be protected no matter what happens. Unfortunately, without proper planning, if the unthinkable occurs to you and your spouse, your children’s future could be at risk.

In North Carolina, parents are the natural guardians of their children. But what if the unthinkable occurs to one or both parents? If you do not have a plan addressing the guardianship of your children, the court chooses the children’s guardian without your input.

Without proper planning your children could face the following:

      • Being temporarily placed in Child Protective Services;

      • The court granting the custody and care of your children to someone you would not want, for example, a family member who has good intentions, but you’d never want to raise your children;
      • The court could get into a long, drawn-out fight as to custody or there could be a challenge as to the guardians appointed;
      • Assets from your estate will be managed by a court appointed guardian until the children become adults. Should your entire estate be managed on behalf of your children by someone the court appoints or someone you decide upon?

      • When your children reach the age of 18, they get a check for whatever assets are left in your estate…will they be ready to handle an inheritance?

      • All information by your children inheriting money when they turn 18 years old is a public document. Anyone could search public records and know your children have inherited your estate. Are they at risk of unscrupulous people or businesses?

      • Guardianship proceedings, probate, and other court costs (as well as attorney fees throughout these proceedings) siphon money from the estate and deprive your children of resources from your estate;

What is a Kids Protection Plan®?

A Kids Protection Plan® is a set of instructions, legal documents and even an ID card for your wallet, which you need to have if you have kids at home who count on you for their well-being and care.

If you are in an accident, your Kids Protection Plan® will make sure your children are never taken into the custody ofChild Protective Servicesor the care of anyone you wouldn’t want because the police don’t have clear instructions from you. And your Kids Protection Plan® will ensure your children are raised by people you choose, not someone chosen by a Judge who doesn’t know you.
